Efforts To Remove Trump From 2024 Ballot Using 14th Amendment Ramp Up: Report





Lawrence Caplan, a Florida tax attorney, became the first to challenge Trump’s candidacy for president in federal court last week, pointing to the Amendment’s “disqualification clause” that says those who “have engaged in insurrection or rebellion” against the government cannot hold office.

He told The Hill that the former president’s grand jury indictments in the Washington, D.C., election interference federal case and the Georgia case stemming from alleged efforts to overturn the 2020 election make his disqualification automatic, despite neither indictment accusing Trump of inciting the mob that attacked the Capitol.

“The bottom line here is that President Trump both engaged in an insurrection and also gave aid and comfort to other individuals who were engaging in such actions, within the clear meaning of those terms as defined in Section Three of the Fourteenth Amendment,” Caplan wrote in a filing last week, challenging Trump’s eligibility to run for office again. “Assuming that the public record to date is accurate, and we have no evidence to the contrary, Trump is no longer eligible to seek the office of the President of the United States, or of any other state of the Union.”

The Fourteenth Amendment to the U.S. Constitution was ratified in 1868 in the aftermath of the Civil War during the Reconstruction Era and was designed to represent a new birth of freedom for previously disenfranchised citizens, according to Cornell University’s Legal Information Institute. The Amendment’s “disqualification clause” was written to bar those who had joined the Confederacy from serving in state or federal office, but would “theoretically still apply” to those who engage in future rebellions or insurrections against the U.S.

Fulton County Superior Court Judge Scott McAfee issued an order on August 21 prohibiting the former president from engaging in any acts of “intimidation,” whether through direct or indirect means, aimed at witnesses and other parties associated with the Georgia case, according to a court document. The order includes Trump’s social media posts and even his reposts of other people’s content. Moreover, Trump cannot communicate directly about the facts of the case with any co-defendant except through legal counsel.

Additionally, U.S. District Judge Tanya Chutkan issued a protective order on August 11 to restrict Trump’s speech about “sensitive materials” in the Washington, D.C. indictment for his conduct related to the 2020 election. “Sensitive materials” often include witness interviews and recordings of conversations.

”While no judge is spoiling for a fight with Trump, judges cannot let defendants flout orders or the justice system is compromised,” Joan Meyer, partner at the law firm Thompson Hine LLP, told the DCNF. “Trump is not above the law and if he tries to test that too aggressively, he may find himself in violation.”

However, Trump’s candidacy grants him significant leeway to speak out, founding professor of Nova Southeastern University Law Center Bruce Rogow told the DCNF.

“Trump of course is in a unique situation and he can, as a candidate, rail against the prosecution generally and he will not be sanctioned,” Rogow told the DCNF.

Trump is now the first presidential candidate who’s ever been badass enough to have his own mugshot. You can’t buy that kind of street cred. And not just any mugshot — it’s the fiercest portrait of righteous rage in the face of persecution in just about ever. It’s a total slay, as the kids say these days.

How Trump’s Trial Schedule Lines Up With The 2024 Election Calendar




“Setting a trial date does not depend and should not depend on a defendant’s personal and professional obligations,” said presiding U.S. District Judge Tonya Chutkan, according to NBC News. “Mr. Trump, like any defendant, will have to make the trial date work, regardless of his schedule,” the judge added.

Indeed, over the next year, Trump’s campaign schedule is poised to become a balancing act while he contends with a bevy of trials — some of which, like with the federal case in D.C., line up with key election dates. The situation has given cause to Trump’s supporters to claim there is election interference at play.





Kicking off a pair of civil matters heading to court, Trump faces a fraud suit brought by New York Attorney General Letitia James that is set to go to trial on October 2.

Then a defamation lawsuit brought by writer E. Jean Carroll, who accuses the former president of raping her, is set to go to trial on January 15, 2024 — coinciding with the first-in-the-nation Iowa Republican presidential caucus.

A hush-money criminal case brought by Manhattan District Attorney Alvin Bragg is scheduled to go to trial on March 25, a date that is right in the middle of a slate of key election contests. States poised to hold March 19 primaries include Arizona, Florida, Illinois, Kansas, and Ohio. Louisiana holds its primary on March 23, while Wisconsin has its primary set for April 2.

The Mar-a-Lago IT director who flipped on Donald Trump in the classified documents case is a part-time DJ and registered Democrat with a history of money troubles, DailyMail.com can exclusively reveal.

Yuscil Taveras, 45, managed to rack up debts of nearly $750,000 despite holding down a string of well-paid tech jobs and moonlighting as 'DJ Juicy.'

The dad-of-two battled back from bankruptcy but now finds himself a pivotal figure in Special Counsel Jack Smith's efforts to convict Trump of mishandling top secret government material.

But when Smith's team threatened him with perjury charges, Taveras fired his Trump-appointed lawyer, 'recanted' his previous evidence, and will likely testify against his former employer when the case goes to trial.

The New York native has scrubbed his social media and kept a low profile since his explosive U-turn was revealed in an August 22 federal court filing.

He and his wife are currently renting a smart $850,000 home in a gated community in Lake Worth, Florida, less than 30 minutes from the Mar-a-Lago Club, where the longtime Trump organization employee has worked for the past several years.

Trump may have violated copyright law by selling mugshot merchandise



But legal scholars say that money may rightfully belong to the Fulton County Sheriff’s Office, which took the photo, as US copyright law stipulates that the law enforcement agency that takes a mugshot is the legal owner of it.

“In the context of photographs taken by law enforcement during the booking process, the author of the mugshot photograph is the law enforcement agency,” the 2022 University of Georgia School of Law’s Journal of Intellectual Property Law states.

As such, Betsy Rosenblatt, a professor at Case Western Reserve University’s School of Law, says there are limitations to what people may do with such photographs.

New leak to CNN says Jack Smith preparing to indict Trump AGAIN

“Questions asked of two recent witnesses indicate Smith is focusing on how money raised off baseless claims of voter fraud was used to fund attempts to breach voting equipment in several states won by Joe Biden, according to multiple sources familiar with the ongoing investigation. In both interviews, prosecutors have focused their questions on the role of former Trump lawyer Sidney Powell,” the media outlet continued.

“According to invoices obtained by CNN, Powell’s non-profit, Defending the Republic, hired forensics firms that ultimately accessed voting equipment in four swing states won by Biden: Georgia, Pennsylvania, Michigan, and Arizona,” CNN noted.

Judge rules Trump committed fraud by inflating his net worth



In all, the judge ruled Trump had inflated the value of his various properties by more than $2 billion. As noted above, Donald Trump Jr. and Eric Trump are also found liable because they signed documents connected with the valuations. Several other people and entities are also part of the case (the full list can be found in the ruling). Even Trump’s lawyers get fined for repeatedly making the same arguments after those arguments had twice been found invalid.

One would not know from reading defendants’ papers that this Court has already twice ruled against these arguments, called them frivolous, and twice been affirmed by the First Department…
Defendants’ conduct in reiterating these frivolous arguments is egregious. We are way beyond the point of “sophisticated counsel should have known better”; we are at the point of intentional and blatant disregard of controlling authority and law of the case…
Accordingly, this Court grants OAG’s motion for sanctions, in part, to the extent of sanctioning each of defendants’ attorneys who signed their names to the instant legal briefs7, in the amount
of $7,500 each, to be paid to the Lawyer’s Fund for Client Protection of the State of New York no later than 30 days from the date of this Order.

So, what does all of this add up to? It means that Trump, his sons and other people have been found liable and now the civil trial brought by the AG will proceed to determine the size of the penalty he must pay. The original lawsuit was for $250 million so the size of the penalty could be substantial.
